These rules set out the terms and conditions you are expected to comply with in using the Niggle services. Please be aware that compliance with this User Code of Conduct is one of the requirements of the General Terms & Conditions. Any submission of User Content by you confirms your acceptance of the conditions below. All definitions of terms used in this User Code of Conduct is the same as in the Terms & Conditions Agreement. This Code of Conduct must be complied with in spirit as well as to the letter. We will determine, at our sole discretion, whether our Code of Conduct has been breached.
The Niggle services rely on Users to maintain high standards of conduct, and to help to moderate other Users. Niggle will not generally moderate User Content, and Users should note that generally feedback and responses submitted will be passed between Users without being seen by Niggle. This makes it all the more important that Users understand that if they receive or become aware of Content that does not comply with our User Code of Conduct, or which they deem to be otherwise inapprorpriate, they should report this to Niggle, using the process provided on the site.
Potential breaches of the User Code of Conduct will be investigated in a timely fashion by Niggle, and the originating User account may be suspended or cancelled. Users are reminded that Niggle reserves the right to delay, delete, moderate or withhold User Content at will.
You are reminded that you are solely responsible for the User Content you submit to Niggle. As such, if you post any material about a business or organisation which is, for example, defamatory or unlawful in any other way, you could be sued by the business or organisation concerned.
All User Content, including but not limited to feedback, suggestions and responses, which you submit to the Niggle services must:
a) Be accurate and truthful where it states facts;
b) Be truthful and be genuinely held, where it states opinions;
c) Comply with the law applicable in England and Wales, and in any country from which it is posted;
d) Be relevant, constructive and helpful to the Member business or organisation to which it is directed;
e) Relate to the User’s own genuine personal experiences, unless it is feedback provided on behalf of another person, in which case it make this clear. Of course you should feel free to explain any negative experiences and to make negative comments but these should be made politely and constructively;
f) Not be defamatory of any person; obscene; offensive; hateful or inflammatory;
g) Not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
h) Not disclose the name, address, telephone, mobile or fax number, e-mail address or any other personal data in respect of any individual;
i) Not infringe any copyright, database right or trade mark of any other person;
j) Not breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
k) Not be in contempt of court;
l) Not be likely to harass, upset, embarrass, alarm or annoy the Member business or organisation, employees, family or friends, or any other User;
m) Not impersonate any person, or misrepresent your identity or affiliation with any person;
n) Not advocate, promote or incite any third party to commit, or assist, any unlawful or criminal act;
o) Not contain any advertising or promote any services or web links to other sites. You must not use the Niggle site to pose as a private individual in order to promote your own product or service, or that of a company to which you are affiliated.
The following uses of Niggle are prohibited:
a) The use of the Niggle services for commercial benefit by individuals who do not declare their commercial interest;
b) The creation of multiple Niggle personal accounts, or multiple accounts for the same business or organisation;
c) False registration on behalf of a business or organisation, by misrepresenting that business or organisation without permission. Please note that if you are registering on behalf of a business or organisation, you must not do so without having obtained all the relevant permissions and authorities, and that this is your sole responsibility;
d) The provision of an email address that is not your own, for the purposes of creating an account;
e) The display without express permission of Niggle marketing literature, stickers, posters or other marketing material, except by businesses and organisations which are currently registered as Members of Niggle. If a Member’s membership has been suspended or cancelled, either by Niggle or by the Member, all marketing material shall be removed immediately from the relevant business premises, even if the suspension or cancellation of membership is the subject of a Dispute or is only temporary;
f) The use of the Niggle logo without explicit consent from Niggle Limited;
g) The impersonation of another person, including the adoption of the identify of a celebrity, a friend or acquaintance.
h) The selling or reselling of any of the Niggle services without Niggle’s express permission;
i) The accessing, retrieving, indexing or use of any portion of the Niggle website for the purposes of constructing, populating or cross-checking any databases, directories, customer lists or mailing lists, other than for your own personal, non-commercial purposes;
j) The interference with, or modification of the Niggle services, or the unauthorised access or restriction of other Users’ access or enjoyment of the Niggle services.
We politely ask that if you have a complaint about Niggle, or would like to dispute any Content on the Niggle website, please tell us first, by emailing complaints@niggle.co.uk, or abuse@niggle.co.ukor by writing to Niggle, 62 Vale Farm Road, Woking, Surrey, GU21 6DP.
Niggle has a Dispute Policy, which we ask that you follow when you wish to dispute or delete an item of User Content or report abusive User Content. Users agree to abide by Niggle’s Dispute Policy which includes an outline of how disputes will be resolved.
Niggle reserves the right to make changes to this User Code of Conduct. In the event of Niggle wishing to make changes of any significant nature, Niggle will give you at least one month’s advance notice of intent, and will inform you of any changes both in the “News” section of the Niggle website, and by e-mail to Users whose e-mail addresses are held by Niggle. You will assume to have consented to these changes if you do not raise any objection to the changes within one month of receiving such notice.
